These are the owner’s details required by Spanish law and the conditions that apply when you use gearwatts.com and the GearWatts app.

2. Purpose of the site

GearWatts (gearwatts.com) is a web app, free of charge during its beta phase, that analyses bike rides from cycling-computer files (.fit, .tcx, .gpx) and from the services you choose to connect, and, optionally, relates them to health data. The public pages (home page, guides and legal pages) are informative. The service is financed by advertising.

Beta phase. GearWatts is currently in beta. During the beta it is free of charge, with limits on the number of registrations and analyses that have not yet been set and may be applied or changed at any time. In the future some features may become paid; the conditions of any paid feature will be published before it applies to you.

3. Conditions of use

By using the site you accept these conditions. You agree to:

  • use GearWatts lawfully, in good faith and for personal, non-commercial purposes;
  • provide true information and keep your sign-in credentials safe; you are responsible for what happens under your account;
  • not try to access other users' data, disrupt the service, overload it, bypass its security measures or extract data from it automatically without our permission;
  • not use GearWatts if you are under 14.

We may suspend or delete accounts that breach these conditions or put the service or other users at risk. We may also change, interrupt or discontinue features, for example the ones still in development, without prior notice.

4. Your content

The files and data you upload or import must be yours or you must have the right to use them. You are responsible for them and for the consequences of uploading files that belong to other people, including files that contain personal data of third parties. You keep all your rights over your data. You grant us only the permission needed to store, process and show it to you (and to the people you choose to share it with) in order to provide the service.

You can delete your rides at any time and ask for the deletion of your account as explained in the privacy policy.

5. No warranty: the analyses are informative

The charts, figures and comparisons produced by GearWatts are informative. They are not medical advice, a diagnosis or a training plan. They depend on the quality of the files and sensors, on the data entered in your profile and on calculation methods that can contain errors or simplifications. Consult a qualified professional before making health or training decisions, and ride in accordance with the traffic rules and your own judgement.

GearWatts is provided "as is" and "as available". We do not guarantee that it will be uninterrupted, error-free or that data will never be lost. We recommend keeping a copy of your original files.

6. Liability

To the extent permitted by law, the owner is not liable for indirect damages, loss of data or profit, interruptions of the service, or for the content, availability or policies of third-party websites and services that GearWatts links to or connects with (for example Garmin, Polar, Hammerhead or Google). Nothing in these conditions limits liability that cannot be limited by law, in particular for intent, gross negligence, or the rights that mandatory consumer law grants you.

7. Intellectual property

The site, its design, source code, texts, guides, graphics and pixel-art animations are the property of the owner or are used under licence, and are protected by intellectual and industrial property law. You may not copy, distribute or modify them without authorisation, except for what the law allows, such as a short quotation with a link to the source. Third-party components are used under their own licences. Map data comes from OpenStreetMap contributors, and orthophotos from the Spanish National Geographic Institute (IGN), under their respective terms.

Garmin, Shimano Di2, SRAM AXS, Polar, Hammerhead, Strava, Apple, Google and any other names, logos or marks mentioned on this site belong to their respective owners and are used only to identify compatible devices, file formats and services. GearWatts is not affiliated with, sponsored by or endorsed by any of them.

The site may contain links to third-party pages. We do not control them and do not assume responsibility for their content. If you notice illegal content, write to us and we will review it.

10. Applicable law and jurisdiction

These conditions are governed by Spanish law. If you are a consumer, you keep the mandatory protection of the law of your country of residence and the right to bring proceedings before the courts that have jurisdiction under the applicable consumer rules. For any other user, the courts of the owner's domicile in Spain will have jurisdiction, unless the law provides otherwise. The European Commission offers an online dispute resolution platform at ec.europa.eu/consumers/odr.
